Privacy Policy.
How Colores Cosmetic Surgery collects, uses, and protects information through this website — and how our separate HIPAA notice governs your medical records.
Last updated: June 2026
Scope & who we are
This Privacy Policy explains how Colores Cosmetic Surgery (“Colores,” “we,” “us,” or “our”) handles information collected through this website and our related online marketing, scheduling, and consultation tools. We are a board-certified plastic and cosmetic surgery practice located at 117 S 17th Ave, Hollywood, FL 33020, USA, serving patients in English and Spanish.
This policy governs website and marketing data only. It does not govern protected health information (PHI) created or maintained in connection with your treatment as a patient. Our handling of PHI is described separately in our Notice of Privacy Practices under the Health Insurance Portability and Accountability Act (HIPAA). Where this policy and the HIPAA notice both apply to the same information, the Notice of Privacy Practices controls for PHI.
By using this website or submitting information through it, you acknowledge the practices described in this policy.
Information we collect
We collect information you provide directly, information generated automatically as you use the site, and information from third-party tools we use. This may include:
- Contact & consultation requests. Name, email address, phone number, preferred contact method, procedure(s) of interest, and any message you choose to send through our contact or consultation-request forms.
- Online medical-intake / consultation forms. Health-related details you voluntarily provide to request or prepare for a consultation, such as medical history, current medications, prior procedures, photographs you upload, and concerns or goals you describe. Information submitted through these forms in connection with care may be treated as PHI — see Health information & HIPAA below.
- Financing inquiries. When you choose to apply for patient financing, applications are submitted to and processed by our third-party financing partners, Cherry and CareCredit. We do not collect or store your full financing application, credit data, or banking details on our website.
- Before/after & testimonial photos. Photographs and statements are used for marketing only with your separate written authorization, and never as a condition of treatment. You may withdraw that authorization in writing at any time.
- Automatically collected data. IP address, device and browser type, pages viewed, referring URLs, approximate location, and interactions with the site, collected through cookies and similar technologies (see Cookies).
How we use information
We use the information we collect to:
- Respond to your inquiries and schedule or follow up on consultations and appointments.
- Provide, operate, secure, and improve our website and online forms.
- Facilitate financing inquiries by connecting you with Cherry or CareCredit at your request.
- Send appointment reminders and, where you have opted in, marketing communications about our services.
- Measure and improve the performance of our website and advertising.
- Comply with legal obligations and enforce our terms, and protect the rights, safety, and property of our patients, staff, and practice.
We use information only for purposes compatible with those described above or as otherwise permitted by law.
Health information & HIPAA
As a healthcare provider, Colores Cosmetic Surgery is a HIPAA-covered entity. Protected health information that we create, receive, or maintain in connection with your evaluation, treatment, or payment for care is governed by HIPAA and by our Notice of Privacy Practices, not by this website policy.
Please do not transmit detailed medical information through general website channels (such as email or non-secure forms) unless specifically directed to a designated secure intake tool. Information you submit through an online medical-intake or consultation form in connection with seeking care will be handled in accordance with HIPAA once it enters our patient-care systems.
If anything in this policy conflicts with the Notice of Privacy Practices with respect to PHI, the Notice of Privacy Practices controls.
How we share information
We do not sell your personal information. We share information only as described here:
- Service providers. Vendors that host our website, manage forms and scheduling, send communications, and provide analytics — acting on our behalf and bound by contract to protect the information.
- Financing partners. When you choose to apply for financing, you interact directly with Cherry and CareCredit, who collect and process your application under their own privacy policies. We encourage you to review those policies before applying.
- Legal, safety & compliance. When required by law, subpoena, or court order, or where we believe in good faith that disclosure is necessary to comply with legal obligations, protect against fraud, or protect the rights, safety, or property of any person.
- Business transfers. In connection with a merger, acquisition, or sale of assets, subject to appropriate confidentiality protections.
Sharing of PHI is governed separately by our Notice of Privacy Practices.
Cookies, analytics & advertising
We use cookies, pixels, and similar technologies to operate the site, remember preferences, measure traffic, and support advertising. These include:
- Google Analytics, to understand how visitors find and use our website.
- Meta (Facebook) Pixel and similar advertising tools, to measure and tailor advertising on third-party platforms.
You can control cookies through your browser settings and limit interest-based advertising. To opt out of Google Analytics, you may install the Google Analytics Opt-out Browser Add-on. To manage advertising preferences, visit your Meta ad settings and industry tools such as the Digital Advertising Alliance and Network Advertising Initiative opt-out pages. Where required, we present a cookie banner so you can accept or decline non-essential cookies.
Your privacy rights
Depending on where you live, you may have rights regarding your personal information. Under the Florida Digital Bill of Rights, and for residents of California (CCPA/CPRA) and other states with comparable laws, these may include the right to:
- Access the personal information we hold about you.
- Correct inaccurate personal information.
- Delete personal information, subject to legal exceptions.
- Opt out of targeted advertising and the sale or sharing of personal information (note: we do not sell personal information).
To exercise any of these rights, contact us through our contact page or using the details in the Contact us section. We will verify your request and respond within the timeframes required by applicable law, and we will not discriminate against you for exercising your rights. Requests concerning your medical records are handled under our Notice of Privacy Practices.
Email & SMS communications
If you opt in, we may send you marketing emails and text messages about our services, promotions, and appointment information.
SMS / text messaging. Consistent with the Telephone Consumer Protection Act (TCPA), we send text messages only with your prior express consent. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP to any message, and reply HELP for assistance. Consent to receive text messages is never a condition of any purchase or of receiving care.
Email. You can unsubscribe from marketing emails at any time using the link in each message. We may still send non-marketing messages, such as appointment confirmations and responses to your inquiries.
Data security
We maintain reasonable administrative, technical, and physical safeguards designed to protect the information we collect against unauthorized access, use, alteration, and disclosure. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. You transmit information to us at your own risk, and you are responsible for keeping any account or access credentials confidential.
Data retention
We retain personal information for as long as needed to fulfill the purposes described in this policy, to maintain our business records, and to comply with legal, tax, and regulatory obligations, after which we securely delete or de-identify it. Medical records are retained in accordance with applicable healthcare laws and our Notice of Privacy Practices.
Children’s privacy
This website is intended for adults and is not directed to children under 18. We do not knowingly collect personal information from anyone under 18 through this website. If you believe a minor has provided us information, please contact us so we can delete it. Care for minors, where appropriate, is arranged directly with a parent or legal guardian.
Third-party sites & financing partners
Our website may link to third-party websites and services, including our financing partners Cherry and CareCredit and the social or advertising platforms noted above. We do not control and are not responsible for the privacy practices or content of those third parties. Information you provide to Cherry, CareCredit, or any other third party is governed by that party’s own privacy policy, and we encourage you to review it before sharing your information.
Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices or applicable law. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the website after an update takes effect constitutes acceptance of the revised policy.
