By accessing, browsing, or otherwise using this website (the “Site”), by submitting any form, or by requesting a consultation, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated herein by reference. If you do not agree with any part of these Terms, you must not access or use the Site.

We reserve the right to refuse service, restrict access, or terminate your use of the Site at our sole discretion and without notice. Your continued use of the Site constitutes ongoing acceptance of these Terms as then in effect.

The content on this Site — including text, articles, descriptions of procedures, before/after imagery, pricing information, the online medical-intake form, and any responses to consultation requests — is provided for general informational purposes only. Use of this Site, submission of any form (including the consultation-request form or online medical-intake form), or communication with the Clinic through the Site does NOT create a physician-patient relationship between you and Colores Cosmetic Surgery or any of its physicians, surgeons, or staff. A physician-patient relationship is established only through an in-person or formally documented clinical evaluation and the mutual agreement to provide care.

They are not a promise, prediction, or guarantee that you or any other person will experience the same or similar results. All surgical and non-surgical procedures carry inherent risks, including but not limited to complications, adverse reactions, the need for revision, and outcomes that differ from expectations. Actual pricing depends on individualized clinical assessment, the specific procedures recommended, facility and anesthesia fees, and other factors that can only be determined after an in-person consultation. The written, itemized quote provided to you following your consultation governs and supersedes any estimate, figure, or statement displayed on or communicated through the Site. All estimates are subject to change at any time without notice. Promotions or financing terms may be subject to additional conditions and availability.

All content on this Site — including but not limited to text, graphics, logos, the “Colores Cosmetic Surgery” name and marks, images, before/after photographs, illustrations, video, layout, design, and the selection and arrangement thereof — is the property of Colores Cosmetic Surgery or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws.

You are granted a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use only. You may not copy, reproduce, republish, distribute, modify, create derivative works from, publicly display, frame, scrape, data-mine, or otherwise use any content from the Site without our prior express written permission. All rights not expressly granted are reserved.

By submitting information, you grant Colores a limited, non-exclusive, royalty-free license to use, store, process, and transmit that information for the purpose of responding to your inquiry, evaluating your request, scheduling and providing services, and operating the Clinic, consistent with our Privacy Policy and applicable law. Please do not transmit sensitive information through unsecured channels; online forms are not a guaranteed-secure or real-time means of communication and should never be used for emergencies.

The Site may reference, link to, or facilitate access to independent third-party services, including patient-financing providers such as Cherry and CareCredit. These third parties are independent entities and are not owned, operated, or controlled by Colores Cosmetic Surgery.

Any application, approval, interest rate, repayment term, fee, or financing decision is made solely by the applicable third party under its own terms, conditions, and privacy practices. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100.00).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law. Importantly, this section governs only website- and Terms-related matters and does NOT limit, waive, or affect any professional medical or surgical liability arising from the actual provision of clinical care, which is governed separately by the applicable consents, agreements, and Florida law concerning the practice of medicine. Some jurisdictions do not allow certain limitations of liability, so portions of the above may not apply to you.

You agree to indemnify, defend, and hold harmless Colores Cosmetic Surgery and its owners, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Site; (b) your violation of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any information or content you submit through the Site, including any inaccurate, unauthorized, or third-party data. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.

This Site is not designed or intended for use in medical emergencies and must never be relied upon for urgent care. Do not use the consultation-request form, online medical-intake form, email, or any other feature of the Site to seek emergency assistance, as these channels are not monitored in real time and there may be a delay or no response. Reliance on this Site in lieu of emergency care could result in serious harm.

These Terms and any dispute or claim arising out of or relating to them or to your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-laws principles. Subject to the binding-arbitration provision below, you and Colores agree that the exclusive venue and jurisdiction for any permitted legal action shall be the state and federal courts located in Broward County, Florida, and you consent to the personal jurisdiction of those courts and waive any objection based on inconvenient forum.

PLEASE READ THIS SECTION CAREFULLY — IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.

Except as otherwise provided below, any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your use of the Site shall be resolved exclusively by final and binding individual arbitration administered by the American Arbitration Association (AAA) under its applicable rules, rather than in court. The arbitration shall take place in or be administered from Broward County, Florida, and each party shall bear its own attorneys’ fees and costs except as otherwise required by applicable law or the AAA rules.

Class-action waiver. All claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice of your decision to opt out to Colores Cosmetic Surgery at the address in the Contact section within thirty (30) days of first accepting these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration. If you opt out, the Governing Law & Venue section above will apply to disputes.

Carve-outs. This arbitration provision does not apply to: (a) qualifying claims that may be brought in small-claims court; or (b) claims for injunctive or other equitable relief to protect intellectual-property rights. This clause governs only disputes concerning the Site and these Terms; it is separate from and does not govern any medical-malpractice or professional-negligence claim arising from clinical care, which is subject to its own applicable laws and agreements.

We may modify, update, or replace these Terms at any time in our sole discretion. When we do, we will revise the “Last updated” date above. Any changes are effective when posted on this page. It is your responsibility to review these Terms periodically. Your continued access to or use of the Site after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Site.
